Terms of use
1. Introduction
Welcome to Kukura Capital, the parent company of Astute (hereinafter referred to as “the Company,” “we,” “us,” or “our”). These Terms of Use govern your use of our fintech application (hereinafter referred to as “the Application”). By accessing or using the Application, you agree to comply with and be bound by these Terms of Use. If you disagree with any part of these terms, you may not access the Application.
2. Use of the Application
2.1 Eligibility: By using the Application, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms of Use.
2.2 License: Subject to these Terms of Use, we grant you a limited, non-exclusive, non-transferable, and revocable license to use the Application for your personal or internal business purposes.

4.2 Kukura Capital shall not be liable for any failure or delay in performing its obligations under these Terms of Use arising out of or caused, directly or indirectly, by circumstances beyond its reasonable control, including, but not limited to, acts of God, acts of government, natural disasters, pandemics, strikes, or war.
5. Indemnification
You agree to indemnify, defend, and hold harmless Kukura Capital, its affiliates, officers, directors, employees, agents, licensors, and suppliers from and against all claims, losses, liabilities, expenses, damages, and costs, including reasonable attorneys’ fees, arising out of or in connection with your use of the Application or any violation of these Terms of Use.
6. Governing Law and Jurisdiction
These Terms of Use shall be governed by and construed in accordance with the laws of the Republic of South Africa. Any dispute arising out of or in connection with these Terms of Use shall be subject to the exclusive jurisdiction of the courts of South Africa.
7. Changes to Terms of Use
Kukura Capital reserves the right to modify or replace these Terms of Use at any time. It is your responsibility to review these Terms of Use periodically for changes. Your continued use of the Application after any such changes constitutes your acceptance of the new Terms of Use.
